Terms of Hire

1. DEFINITIONS

(a) The term "Owner" refers to Glassware Hire Sydney and the website www.glasswarehire.com.au.

(b) The term "Hirer" refers to the individual, company, or entity renting equipment from the Owner.

(c) "Equipment" refers to all product and accessories provided to the Hirer.

(d) "Terms" refers to these Hire Terms and Conditions.

2. CONDITIONS OF HIRE

(a) The hire of the equipment will begin on the start date outlined in your invoice and will continue for the duration specified. The Hirer has the right to use the equipment during the agreed hire period. Any extension beyond this period must be approved by Glassware Hire Sydney.

(b) The Hirer may not relocate the equipment or any of its parts from its original installation site without prior approval from the Owner.

(c) The Hirer agrees to use the equipment only for its intended purposes and in accordance with its suitability (e.g., indoor vs outdoor use).

(d) The Hirer accepts responsibility for the equipment and will be liable for any damage incurred.

3. PAYMENT

(a) The Hirer agrees to pay the hire fee and the damage waiver fee as outlined for the hire period, along with any applicable GST, stamp duties, levies, penalties, or delivery charges.

(b) Payments for the required fees must be made to Glassware Hire Sydney prior to the hire period's start date via our website.

(c) Failure to return the equipment on time or in accordance with the agreement will result in continued rental charges until the equipment is returned.

(d) Orders placed less than 7 days before the event require full payment to confirm the booking. Glassware Hire Sydney reserves the right to decline any booking at its discretion.

(e) All prices listed on this website are in Australian Dollars (AUD).

4. CANCELLATION

The Hirer may cancel an order, but the following fees will apply based on the cancellation date:

(a) Cancellations or reductions made 28 days or more before the event will forfeit 30% of the total hire fee.

(b) Cancellations or reductions made 8 to 27 days before the event will forfeit 75% of the total hire fee.

(c) Cancellations or reductions made within 7 days of the event will forfeit 100% of the total hire fee.

(d) Orders placed outside our delivery zone or that are cancelled by Glassware Hire Sydney will incur a $15 merchant and credit card fee, which will be deducted from any refund.

For all other cancellations, the above cancellation policies will apply.

5. DELIVERY & COLLECTION

(a) The Hirer must return all hire goods/glassware rinsed, dry, and stored upright in the provided containers. Glass storage boxes must be wiped clean and returned in the condition they were received. Failure to do so will result in the loss of the hire bond.

(b) The Hirer must grant reasonable access to Glassware Hire Sydney representatives for the collection or inspection of the equipment.

(c) The Hirer must ensure that the event site is safely accessible.

(d) The Hirer is responsible for any injury, loss, or damage incurred by Glassware Hire Sydney or its representatives while on the event site.

(e) Prices for delivery are based on standard ground floor delivery only. If special delivery requirements are needed, please inform us and we will provide an adjusted quote (e.g., stairs, elevator access, special permits).

(f) Please verify the delivery zone before placing an order. Orders outside the service area may incur additional charges or may not be accepted and refunded.

6. DAMAGE

(a) The Hirer assumes responsibility for the equipment from the time of delivery until it is collected by the Owner. The Hirer is liable for any loss or damage to the equipment during this period. The damage waiver covers normal wear and tear but does not apply to:

(i) Damage resulting from misuse, overloading, exceeding rated capacity, or improper handling of the equipment.

(ii) Loss of equipment due to mysterious disappearance.

(iii) Damage from use contrary to the terms of this agreement.

(iv) Loss or damage for unknown reasons.

(v) Spills of red wine on furniture or décor items.

(b) The Hirer is responsible for protecting the equipment from the elements during use, storage, or any waiting period before pickup.

(c) The Hirer must maintain liability, property, and casualty insurance at their own expense, providing adequate coverage to protect both the Owner and the equipment from any claims or damages.

(d) Glassware Hire Sydney is not liable for any injury, loss, or damage to people, property, animals, or anything else resulting from the use of the rented equipment, and the Hirer indemnifies the Owner from such claims.

(e) Any person signing on behalf of the Hirer affirms they have the authority to bind the Hirer to this agreement and indemnifies the Owner against any losses arising from a lack of such authority.

(f) If the Hirer consists of more than one person, liability will be joint.

(g) By booking or confirming the hire with a signature, deposit, or payment, the Hirer acknowledges and agrees to these Terms and Conditions.

(h) If equipment is damaged, the Hirer may be offered the option to purchase the damaged item.

7. GLASSWARE HIRE BREAKAGES, DAMAGE, AND DISAPPEARANCE

The following charges apply for damage or loss:

  • Corflute glass holders: $220 incl GST for 5 or part thereof (sold in lots of 5).
  • Red Wine, Champagne Flutes, Drinking Jars: $7.70 incl GST each.
  • HiBall, Oca Old Fashioned, Manhattan Glasses, Beer Glasses: $6.60 incl GST each.
  • Margarita Cocktail Glass: $8.80 incl GST each.
  • Martini Glasses: $8.80 incl GST each.
  • Arcoroc Glass Jugs/Stainless Water Jugs: $15.00 incl GST each.
  • Champagne Bowls: $95.00 incl GST each.
  • Tubs: $30.00 incl GST each.
  • Other items: Market replacement cost plus delivery.

8. FORCE MAJEURE

"Force Majeure" refers to any event or circumstance beyond the reasonable control of a party, such as natural disasters, war, weather conditions, fire, labor disputes, or changes in law. Neither Glassware Hire Sydney nor the Hirer will be in breach of this agreement or liable for delays or failure to perform due to Force Majeure. Glass Hire Sydney will notify the Hirer in writing of any Force Majeure events.

Glassware Hire Sydney is not responsible for any indirect or consequential losses incurred by the Hirer, including loss of revenue, profits, business, or goodwill, or any damage resulting from delays caused by Force Majeure.

9. MISCELLANEOUS

The Hirer agrees to ensure that the event site is free of obstructions to allow for safe and proper setup of the hired equipment. These Terms and Conditions are governed by the laws of Victoria, and both the Hirer and the Owner submit to the jurisdiction of the courts of Victoria.
